HUNTSVILLE, AL (WAFF) -
The man who shot and killed
Huntsville Police officer Eric Freeman in 2007 will not have his conviction
vacated, a judge ruled.
The shooting happened
after a traffic stop in South Huntsville.
Kenneth Shipp, the man convicted
of the shooting, said WAFF's Elizabeth Gentle's trial blog should be considered
as new evidence in the case.
But the court disagreed
with Shipp's suggestion.
A Madison County jury
convicted Shipp of capital murder and he was sentenced to life in prison.
With the judge's
permission, Gentle blogged about the trial, along with other members of the
media.
The court ruled that no
laws were violated by the blog, and the record made it clear the judge examined
the blog procedure.
Kenneth Shipp is serving life in prison without
the possibility of parole at Holman Prison in Atmore.
