ATHENS, AL (WAFF) -
A Limestone County judge issued an order stating the District Attorney must tell Joel Moyers' defense team if the State of Alabama will seek the death penalty.
Moyers is charged with capital murder for the September 2012 shooting death of Brandon Hydrick.
Moyers remains in jail without bond. His bond was revoked with the capital murder indictment.
Moyers spent several days in the hospital after that indictment. He overdosed after learning about the indictment.
Moyers is scheduled to go to trial in June. Friday, his attorney filed a motion asking for more time to prepare for trial. The judge has not ruled on that motion.
