Marshall County man will remain on death row for killing pregnant wife

ALBERTVILLE, AL (WAFF) - The Supreme Court has decided a Marshall County man will stay on death row.

This is the first time a person in Alabama has been sent to death row for the murder of a pregnant woman, but it wasn't without some roadblocks.

Jessie Phillips of Albertville was convicted in 2012 of the 2009 murder of his wife, Erica Droze Phillips, and their unborn child. Erica Phillips was shot in the head at a Guntersville car wash.

A jury recommended death for hr husband. The judge followed that recommendation.

The Supreme Court later came back late in 2015, asking the court to resentence Phillips because of defects in the sentencing order. He was Phillips resentenced to death earlier this year.

This time the court ruled they found no errors and affirmed the death sentence.
