MARSHALL COUNTY, AL (WAFF) - A man on death row is asking a Marshall County judge for a new trial, claiming his defense attorney was ineffective.
Rick Allen Belisle was convicted of the brutal murder of a convenience store clerk in Boaz more than 15 years ago.
His new attorney was present along with the attorney for the state attorney general's office as they met Monday to set up plans for a formal hearing.
Belisle was not in the courtroom for the status hearing, but family members of the victim were.
Belisle was convicted of the 1999 murder of Joyce Moore at the T&J Kwik Mart in Boaz where she was working.
Investigators said she was beaten to death with a 6-pound can of peas and a metal pipe.
Belisle's wife was convicted of murder. She received a 20-year sentence and testified against her husband at trial.
The state supreme court upheld the murder conviction and death sentence back in 2008.
The judge said in court he expected to set a formal hearing date for sometime in November.
