MADISON COUNTY, AL (WAFF) - Prosecutors and defense attorneys met in court Friday to hammer out a timeline for an appeal hearing in the case of a man on death row for killing a police officer.
Attorneys on both sides went before Judge Karen Hall about Benito Albarran's rule 32 appeal. Albarran's attorneys said he didn't have effective counsel at trial nearly a decade ago.
They also said that the attorneys made decisions that hurt his case, including the decision to allow the trial to happen in Madison County.
Prosecutors said this is just the latest in a series of appeals that are keeping this case before a judge.
"Unfortunately, this is a process." said District Attorney Rob Broussard. "You can't even put a timeline on it truthfully, that's my experience.. This issue is not fully resolved."
Albarran is currently on death row.
His rule 32 hearing will likely be held next June.
