BRIDGEPORT, AL (WAFF) - The family of a man who died while swimming in a Jackson County pool has now filed suit against the city of Bridgeport.

Reports came out soon after the incident that the pool was very murky.

The suit claims not only was the city negligent but implies the lifeguards failed to do their job as well.

Rovena Hardrick is filing suit against the city of Bridgeport in relation to her brother's death.

Bert Winston Jr. died in July of 2014 while swimming at the city pool.

The suit claims Winston was on a church outing there and fell into the deep end of the pool. Several children witnessed it and immediately reported it to the lifeguards.

The suit claims the six lifeguards insisted Winston had left through a rear gate while the children remained adamant that Winston had sunk to the bottom of the deep end.

It was sometime after that the suit claims a church member found Winston's body at the bottom of the pool.
