Marshall County man on trial after child porn found on his lost cellphone

GUNTERSVILLE, AL (WAFF) - A lost cellphone could land a Marshall County man in jail for years to come. Trial for Kenneth Wayne Ennis got underway Wednesday.

He's charged with four counts each of production and possession of child pornography.

Prosecutors say his lost phone was discovered by employees at the Y-Mart in Boaz back in 2015. Those now former employees testified Wednesday they found the phone in a register drawer where lost items are kept. When they looked through the phone trying to find out who owned it they stumbled across sexually explicit pictures.

The former employees testified they found pictures of a sex act with a one to 2-year-old child. They also found when they opened the Facebook account of the person on the phone it was Ennis. The girls both testified as they were getting ready to call police a patrol officer came into the store and they gave the phone to him and a report was taken.

Prosecutors warned jurors they would be seeing some very disturbing and graphic pictures during this trial.

Boaz police Chief Josh Gaskin took the stand. He was the lead investigator back in 2015 when the phone was found. Gaskin testified the phone was sent to a federal Secret Service lab in Hoover. He said the results came back that there were four pictures that were child porn and that the pictures had been taken by the camera on the phone.

The former investigator said they made efforts to try to find out who the victim was in the pictures but was unable. Ennis was subsequently arrested at his home.

Gaskin also testified they took several pieces of electronics from his home at the time they went to arrest him after getting a search warrant. He said one of the CD or DVD disks had “Girls” written on it.

Testimony resumes on Friday.
