Morgan Co. judge: No to delay in murder case

DECATUR, Ala. (AP) - A Morgan County judge has denied a request to delay the third trial for capital murder suspect Daniel Wade Moore.

Circuit Judge Steve Haddock denied a request from Moore's defense lawyers Tuesday for a delay in order to search for a former Decatur police officer who was at the murder scene.

Prosecutors opposed the delay, saying the defense has had 10 years to find the officer.

Haddock said the officer's testimony would not be substantial enough to delay the trial.

The court is scheduled to convene for jury selection on April 13.

The 35-year-old Moore is charged in the May 12, 1999 slaying of 39-year-old Karen Tipton.

He has stood trial twice on charges that he raped, robbed and stabbed Tipton in her southwest Decatur home.
