DECATUR, AL (WAFF) - A Lacey's Spring man has been charged with the murder of his 4-month-old child.

Gary Lee Wilbourn, 36, was charged with murder in the death of his daughter, Amy Wilbourn, who died on Dec. 26.

According to Morgan County Sheriff Greg Bartlett, Amy was taken to Crestwood Hospital on Dec. 19 with seizures and difficulty breathing. She was transferred to Huntsville Hospital's Pediatric Intensive Care Unit that evening, where she was diagnosed with shaken baby syndrome and remained on life support until her death

The parents reported that their 2-year-old child had fallen on Amy's head that day at their Valley Street home, and she became ill that evening. However, investigators later discovered a different sequence of events.

"He said the parents had gotten into an argument, and he picked up the child and shook it," Wilbourn said.

Gary Wilbourn was already in custody in the Madison County Jail on unrelated charges when charged in his daughter's death. His bond on the murder charge has been set at $500,000.

Bartlett said Wilbourn's other child is now in state custody.
