Judge sets new date for Schmitz fraud trial

BIRMINGHAM, Ala. (AP) - A federal judge has set a Feb. 10 trial date for Rep. Sue Schmitz on fraud charges.

The first trial for the Toney Democrat ended with a deadlocked jury and U.S. District Judge declared a mistrial.

Jurors told Proctor three times that they were unable to reach an unanimous verdict.

Federal prosecutors accused Schmitz of taking more than $175,000 in pay from a job in the two-year college system but performing little or no work.
