STEVENSON, AL (WAFF) -

Stevenson’s former police chief will be sentenced November 2nd after a federal judge denied his motion for a new trial.

The federal judge determined that none of the 10 grounds Daniel Winters argued warranted a new trial.

Winters was convicted in July of violating the civil rights of a man he was arresting.

Winters has been free on bond since his conviction.

The indictment under which Winters was convicted alleges that in March of 2015, Winters physically assaulted a man being arrested and willfully failed to intervene to stop another person from using unreasonable force during the arrest.

The assault caused the man being arrested to suffer bodily injuries.
