Legal expert breaks down possible outcomes for Roy Moore

A unanimous vote is the only way the Court of Judiciary can throw Chief Justice Roy Moore out of office. WAFF 48’s legal expert, Mark McDaniel, said there are several possible outcomes from Moore's ethics trial.

McDaniel said the Court of Judiciary, in this case, is a panel of eight people that's made up of judges, lawyers and two governor-appointed members.

They can find him not guilty. But in order to reprimand or suspend Moore, McDaniel said at least six members have to support it. He said all eight members have to be on board to remove him from office.

If that happens, it doesn't stop Moore from running for office again during the next election cycle.

“If they find him guilty of one of the cannons of judicial ethics, this is not a criminal case. This is not adjudication of a crime and he can certainly run for office again,” said McDaniel.

If he’s kicked out of office, Moore can also appeal his case to the Alabama Supreme Court.

McDaniel said the Court of Judiciary isn't required to wait the full 10 days to issue their opinion. They can do it at any time between now and then.
