MARSHALL COUNTY, AL (WAFF) - A man found guilty of murdering his son is appealing his conviction.
JC Samuels was convicted three years ago in the murder of his son, Greg. Samuels feels he got ineffective counsel so he asked the judge to give him a new trial Wednesday morning.
Prosecutors argued at trial Samuels waited for his son to return to their Robert Circle home and shot him with a .22-caliber rifle in the front yard. Prosecutors said the two had been arguing before the murder.
Samuels said his attorney didn't discuss an offer and failed to preserve an objection during jury instructions. He also said his 45-year sentence isn't fair.
"Yeah, it's still unjust. Yes sir. But I will eventually make it," Samuels said.
The judge has asked both sides to file briefs and said he would rule at a later date.
