Common-law rules now apply to AL same-sex couples

HUNTSVILLE, AL (WAFF) -

Alabama is a common law state, which means state law regarding common-law marriage now also applies to same-sex couples.

Legal analyst Mark McDaniel says a gay couple can have a common law marriage if they meet the requirements.

"If they want to have an agreement to be husband and husband [or] husband and wife, and they want to cohabitate as such, and it's mutually exclusive to all others, then they would be married in Alabama just like if they went through the ceremony."

McDaniel says couple in a common law marriage will receive the same benefits as a couple that has gone to the courthouse and received a marriage license.
