11th Circuit to hear oral arguments in Sparkman Middle rape bait case

HUNTSVILLE, AL (WAFF) - The 11th Circuit Criminal Court of Appeals will hear oral arguments in the Sparkman rape bait case. A date for oral arguments has not been set by the court.

The father of a Sparkman Middle School student filed a federal lawsuit against Madison County School leaders. He claims a school employee used his daughter as bait to catch a student accused of harassing girls at Sparkman Middle School in 2010. The father says that student raped his daughter in a school restroom and nobody from the school intervened.

A federal judge dismissed the lawsuit. The plaintiff then appealed to the 11th Circuit. The Department of Justice submitted a brief in support of the victim. Thirty-three woman's groups also joined together to submit a brief in support of the teenager girl.

The DOJ brief states the school district knew of the attacker's long history of sexual misconduct. Over the course of two school years, the student had 16 prior incidents. Six of those incidents involved sexual misconduct. Four of the incidents involved violence or threats of violence.

The DOJ also says the school district destroyed records from previous years and failed to maintain any record of unsubstantiated complaints against the attacker.

Following the DOJ brief, the Madison County Board of Education released the following statement: "The attorneys for the Board of Education and school officials are confident that the 11th Circuit Court of Appeals will rule in favor of the Board and the administrators. Our attorneys recommend that we not discuss ongoing litigation."
