MONTGOMERY, AL (WAFF) - A federal judge says death row inmate Tommy Arthur will not be killed in next month's scheduled execution.

Arthur was convicted for the murder of a Muscle Shoals businessman in 1982.

The state Supreme Court recently set the execution date for February 19.

According to Judge Keith Watkins, a 2012 ruling to stop the execution remains in effect until the courts lift it.
