Next month, a judge is expected to set a re-sentencing date for a Moulton man convicted of capital murder.
Evan Miller beat and robbed Cole Cannon in 2003. Miller was 14-years-old at the time of the murder.
A Lawrence County judge sentenced Miller to life in prison without the possibility of parole.
Since that sentencing, the U.S. Supreme Court has ruled that sentence unconstitutional.
Miller's hearing is scheduled for September 5.
