Tuskegee VA employee accused of sexually assaulting volunteer

TUSKEGEE, AL (WSFA) -

A Tuskegee VA Medical Center employee is facing federal charges for allegedly sexually assaulting a hospital volunteer with special needs.

Eric Allen, 44, is scheduled to appear in federal court Tuesday. Court records show Federal Judge Charles Coody will hear the prosecution's case to further detain Allen until his trial. Federal prosecutors requested the detention hearing, citing Allen is a flight and safety risk.  Allen has been assigned a public defender for this hearing.

According to court documents, Allen made contact with the female volunteer worker who suffered from Down Syndrome on Aug. 8 outside a unisex restroom in the Tuskegee VA hospital. That's where surveillance footage allegedly captured Allen's contact with the victim before, during and after the incident.

The graphic affidavit says Allen led the victim into the restroom and touched and kissed her against her will. The victim was "incapable of appraising the nature of the conduct, as well as physically incapable of declining participation in, or communicating unwillingness to engage in the act," according to the affidavit.

In addition to the surveillance video, another VA employee observed the victim leaving the restroom telling Allen "you need to stop" as he was reportedly seen zipping up his pants. Allen then approached the VA employee, putting his hands in the air saying "Ain't nothing happen." He then reportedly appeared extremely nervous and rapidly left the area. 

The victim identified Allen to police and explained what happened behind closed doors. After asking him to stop numerous times, she said he finally moved and allowed her to leave.

Allen's title at the Tuskegee Medical Center is a "Compensated Work Therapy Employee." According the Veteran's Affairs website, CWT employees operate a vocational rehabilitation program that "endeavors to match and support work ready veterans in competitive jobs, and to consult with business and industry regarding their specific employment needs."

In some locations CWT is also known as Veterans Industries -- these designations are synonymous. Allen's job description also allows him to lend guidance in addressing ADA regulations compliance.
