HUNTSVILLE, AL (WAFF) -

A jury was selected and seated Monday for the trial of the former teacher's aide accused of abusing a child.

Michael Horton is charged with sodomy.

He worked for Providence School in Huntsville and is accused of abusing a child in Madison in 2008.

Earlier this year, the state decided not to pursue charges against Horton. Prosecutors said the victim was no longer cooperating.

The victim's family, however, said that was not the case - and the trial was put back on the docket.

The prosecution and defense were able to give their opening statements in court Monday. Testimony resumes Tuesday.
