Deputy shooting case waived to grand jury

MORGAN COUNTY, AL (WAFF) - The case against a former Morgan County deputy is headed to the grand jury.

Brian Fulford waived his right to a preliminary hearing on Wednesday.

He is accused of shooting a man at the south Huntsville Walmart in April.

Investigators said Fulford was shopping at the store on South Memorial Parkway when he saw a suspect who was wanted for burglary in Morgan County.

They said he tried to arrest that man and ended up shooting him in the buttock.

Fulford said his gun fired accidentally. He was charged with assault.
