ALBERTVILLE, AL (WAFF) -

An illegal immigrant charged with a deadly hit-and-run suspect has asked for a lower bond.

Juan Gomez is asking for a lower bond than the $150,000 originally set by a judge.

Gomez is charged with a felony-leaving the scene of an accident. Bradley Benefield died after being struck on Baltimore Avenue two weeks ago.

Gomez' attorney argues that his client is not a flight risk because he owns his own business, is active in his church, and does not have a criminal history.

The Immigration Customs Enforcement Agency placed a hold on him.
