Bond set for Ozark kidnapping, sex assault suspect

More than a month after being arrested in connection to the vicious kidnapping and sexual assault of an Ozark mother and her child, the man accused of the crimes faced a judge.

David Pitts, 44, had his initial court appearance Wednesday where he was read his rights and made aware of the string of felony charges he faces, some of which could result in one or more life sentences if he's found guilty.

The charges include: two counts of first degree kidnapping, one count of first degree rape, one count of sexual abuse of a child under 12, one count of first degree burglary, one count of first degree theft of property and one count of first degree criminal mischief.

The State asked Dale County District Judge W. Stanley Garner, Jr. to deny Pitts any bond saying he, "is a serious danger to the community and a serious risk of flight." The State also pointed to the fact that Pitts is facing seven felonies committed while armed with a pistol and rifle and claims he wanted to kill the victims before he fled.

Pitts' legal counsel cited his life-long ties to the Ozark area and his lack of felony convictions or criminal activity during.

Ultimately, Judge Garner agree with several of the State's arguments, but still set bond at $850,000. It must be paid in cash and should Pitts make bond, he will be required to wear an electronic ankle monitor.

Pitts was wanted for allegedly kidnapping and sexually assaulting a 30-year-old Ozark woman and 8-year-old Ozark Child on July 24. According to police, Pitts took the victims to a secluded area off of Alabama Highway 123 where he is said to have raped the woman and molested the child.

Ozark police believe Pitts held the victims all night. Then, the next morning he let them go, forcing them to drive him to an undisclosed location and drop him off.

Pitts was arrested on July 28 by the U.S. Marshal Service in South Florida after authorities received a tip that he was possibly being treated at Bethesda Hospital East in Boynton Beach, Florida.

He was taken into custody without incident at the hospital and later extradited back to Alabama to face charges.
