Limestone County man who shot and killed nephew will receive new trial

LIMESTONE, AL (WAFF) -

A Limestone County man who shot and killed his nephew will get a new trial. 

Keith George's conviction was overturned by the Alabama Court of Criminal Appeals on Aug. 30, 2013, according to his attorney, Michael Sizemore. The State of Alabama filed an application for rehearing and the Court of Criminal Appeals affirmed its decision to overturn the conviction on March 14, 2014. 

The State then filed a petition for writ of certiorari with the Alabama Supreme Court, which was denied on July 11, 2014. Keith's case is remanded back to the Limestone County Circuit Court for further proceedings.  

George shot and killed his nephew, Rusty George, in Limestone County in 2009.

Investigators said his nephew tried to leave with his girlfriend. George stopped the boy and said he was too drunk to drive.

Rusty George hit his uncle and Keith George pulled out a gun and shot him three times in the thigh, leg and chest.

The nephew died at the hospital.
