FLORENCE, AL (WAFF) -

The battle to build a new hospital in the Shoals continues as RegionalCare faces yet another hurdle in the proposal phase.

According to court documents, attorneys for Helen Keller Hospital are appealing the judge's ruling in favor of the new facility.

In June an Alabama Judge ruled in favor of the board's decision to allow RegionalCare to build a new 280-bed hospital in Florence. A decision Helen Keller Hospital has opposed since the beginning. RegionalCare purchased ECM Hospital back in 2010 with the hopes of building a new hospital. Plans have faced several set-backs from opposition over the last few years and ECM leaders hope this is the last one they face before they can move forward.

In a statement released by Helen Keller CEO Doug Arnold, the appeals have nothing to do with a new facility. He said it had to do with the number of beds in the new facility, citing 280 beds is over the maximum number of 233 as defined by the State Health Plan.

"There is nothing in our appeal that prevents RegionalCare from beginning construction of a new hospital," said Arnold. "We have made this appeal because we believe that it is the right thing to do for our community. By making sure that the area is not over-bedded, each hospital will have a much better chance of financial stability well into the future."

There's been no word at this point as to when the Civil Appeal Court will make a ruling on this case. Officials speculate it may take several weeks or months.
