Wrongful death suit against HPD set for 2015 trial

HUNTSVILLE, AL (WAFF) -

A case against the Huntsville Police Department will go to trial next year.

Nancy Smith claims her teenage son died at the hands of a Huntsville police officer. She said officers used excessive force during an undercover drug bust.

Smith said an officer threw her son down to the ground and pepper-sprayed him, then used a sharp object to dislodge what they thought was a bag of drugs that he swallowed, breaking her son's ribs in the process.

He died five days later.

According to the lawsuit, police never found a bag of drugs.

A jury will hear the case in federal court February 15.
