MADISON COUNTY, AL (WAFF) -

The case against a former teacher's aide accused of sodomy is back on the court docket.

In January, Madison County prosecutors told the court they decided not to pursue charges against Michael Horton because the alleged victim was no longer cooperating.

The victim's family said that was not the situation, and now the case is set to go to a jury this week.

Horton worked at Providence School in Huntsville. Madison Police said he abused the child in 2008.
