Judge upholds revocation of Foxx Trap licenses

BIRMINGHAM, AL (WBRC) -

A judge has ruled in favor of the Birmingham City Council to revoke the Foxx Trap's licenses.

The ruling came down Friday from Circuit Judge Tom King Jr. Nightclub owners had argued that Birmingham councilors had been "rash and irresponsible" in their decision to close the club.

King noted the various issues like officer testimony of underage drinking and serving of alcohol, lack of verifying identification at the entrance, the presence of drugs, operation of the club at over-capacity, employment of unlicensed dancers, and numerous police service calls" as valid reasons for the city council to revoke the licenses.

King said in his final ruling that Birmingham's findings that "the Foxx Trap has created a nuisance and substantial risks that are detrimental to the public health, safety, and welfare and has operated as a nuisance within the past six months" were not arbitrary or capricious

The Birmingham City Council had originally voted to revoke the licenses on May 6, but the Foxx Trap was granted a temporary restraining order to keep the club open during appeal. Saturday, May 10, a shooting took place between security officers at the club and one man was killed. Judge King rescinded the restraining order during a Tuesday morning hearing.

The club owners have not said whether they will appeal the decision.
