Judge delays trial for Joyce Garrard

ETOWAH COUNTY, AL (WBRC) -

After a hearing on Friday morning, the judge in Joyce Garrard's trial delayed the start date to give defense attorneys time to speak to several expert witnesses for the prosecution.

The trial is now set to begin on September 22, 2014.

Garrard's defense attorneys have been granted access to all of the prosecution's files on Jessica Hardin as well as Hardin's attorneys.

The judge also declined a request from the defense to dismiss the case.

Joyce Garrard is charged with capital murder in the 2012 death of her 9-year-old granddaughter, Savannah Hardin. She is being held without bond in the Etowah County Jail. Jessican Hardin, Savannah Hardin's stepmother, is charged with felony murder in the child's death. Hardin is currently out on a $150,000 bond.

Prosecutors say Garrard made the nine-year-old girl run for three hours as punishment for a lie about eating a candy bar on Feb. 17, 2012. The child collapsed and died three days later at a hospital. Hardin is accused of not intervening.

Garrard's attorneys filed the motion to dismiss the case on May 6, saying the state violated the court's schedule for producing their evidence. They say the state did not provide a list of experts and a report for each by March 31.

Another hearing has been set for June 19 to address several other motions filed by the defense that were not addressed at Friday's hearing.

    The Guntersville Police Department have released news details on a double shooting late Friday afternoon that left one man dead.

    The incident occurred at approximately 5:30 p.m., when police from multiple law enforcement agencies responded to a 911 call reporting two people had been shot on Edmonds Road.
