MADISON COUNTY, AL (WAFF) -

A preliminary hearing has been set for a former Morgan County deputy charged in connection with a Walmart shooting, according to court documents.

The incident happened in April at a Huntsville Walmart. Investigators said former deputy Brian Fulford was shopping at Walmart when he saw David Horton who was wanted in connection with a Morgan County burglary.

Authorities said that during the arrest of Horton, Fulford's gun fired and shot Horton in the buttocks. Fulford claimed his gun fired accidentally.

Fulford was arrested and charged with second-degree assault. The preliminary hearing has been set for July 2.
