Man shot by former deputy hires counsel

HUNTSVILLE, AL (WAFF) -

The man shot by a former Morgan County deputy has hired an attorney.

David Horton hired a civil attorney from Birmingham, but so far no lawsuit has been filed over the shooting.

Last month, an off-duty Morgan County deputy, Brian Fulford, spotted Horton at a South Huntsville Walmart. Horton had felony warrants; the deputy shot Horton while trying to arrest him.

Horton's attorney said that his client would like to avoid a lawsuit, but he is pursuing litigation against the former deputy, the Morgan County Sheriff's Office, and others.

Fulford resigned from the sheriff's office after Huntsville Police arrested him for assault in connection with the incident. Fulford said he fired his gun by accident.
