MADISON COUNTY, AL (WAFF) -

The Morgan County deputy charged with assault in connection with a shooting that happened at a Huntsville Walmart has resigned, according to Morgan County Sheriff Ana Franklin.

Sheriff Franklin said Fulford came in Monday for his administrative hearing and announced his resignation.

According to investigators, off-duty Deputy Brian Fulford was shopping at Walmart when he spotted David Horton who was wanted in connection with a burglary that happened in Morgan County. During the course of the arrest, Horton suffered a minor gunshot wound to the buttocks.

Fulford claimed his gun fired accidentally. However, Huntsville Police investigators believe there is enough evidence to support an assault charge.
