Jury selection begins in capital murder trial

MORGAN COUNTY, AL (WAFF) -

Jury selection began Monday in the capital murder trial of a Lacey's Spring man accused of killing his infant daughter.

Authorities arrested Gary Lee Wilbourn in 2008 after investigators said he shook his 4-month-old daughter, Amy Jean Wilbourn, because she wouldn't stop crying.

A Morgan County judge ordered a former medical examiner to testify in Wilbourn's trial. Dr. Emily Ward currently lives in Mississippi, although tax records indicate Ward owns two homes in Huntsville.

Dr. Ward performed the only autopsy on the child. Ward worked for the Alabama Department of Forensic Sciences from 2001-2013 and retired.

The judge sent a request to the Hinds County, Mississippi, court requesting help in locating Ward and compelling her to testify. The order states Dr. Ward has continuously made herself unavailable and has avoided subpoenas.

With jury selection beginning, it is clear that the trial must go on. Wilbourn's trial was originally supposed to start in February but a mistrial was declared due to weather-related problems during jury selection.

The Morgan County District Attorney said that while they are actively seeking Dr. Ward, the trial will move forward regardless.
