Deputy charged with assault after Wal-Mart shooting

HUNTSVILLE, AL (WAFF) - The investigation into Tuesday's shooting at the Wal-Mart was concluded. The incident involved Morgan County Deputy Brian Fulford.

The incident happened as Deputy Fulford attempted to arrest David Horton whom he knew was wanted on a felony charge related to a Morgan County burglary. During the course of the arrest, Horton sustained a minor gunshot wound.

Horton was transported to Huntsville Hospital with non-life threatening injuries. He was treated and released to the Morgan County Sheriff's Department, who then transported him to Morgan County Jail. He was then booked on a felony charge.

Huntsville Police investigators presented their findings to the Madison County District Attorney's Office. Brian Fulford was charged with 2nd degree assault and had bond set at $5,000. Deputy Fulford was released on bond after being booked into jail.

Fulford is currently on paid administrative leave. The Sheriff's Department will have a meeting on Monday to discuss his status of employment with the department.
