On Your Side: Unreturned apartment deposit

BIRMINGHAM, AL (WBRC) -

The $200 April Peterson paid when she moved into her apartment was not returned when she moved out.

She called for help and the FOX6 Call for Action team took on her apartment deposit complaint.

"They were very good about responding calling me back and keeping me updated," Peterson said.

After weeks of hard work by one of our volunteers, we got some results: April got a refund of $100. She was happy with the help from Call for Action even though it was not quite what she wanted.

"Even though I was angry, I had to calm down and see how grateful I was and I really appreciate them," Peterson said.

"I got half of my deposit back which is really great. In the past, I understand that no one gets their deposit back so I was really grateful," she said.

If you ever find yourself in a similar situation, its important that you know what the Alabama Uniform Residential Landlord and Tenant Act says:

ALA.CODE §35-9A-101 et seq. (1975)

-Money can be applied to rent that is due and damages to the property

-Renter must provide landlord with a new address

-Landlord must send an itemized list with the amount due 35 days after termination of lease

-If landlord fails to mail a refund or list within 35 days, the landlord has to pay double the original amount of the deposit
