HUNTSVILLE, AL (WAFF) -

A Morgan County deputy was put on paid administrative leave while investigators determine how and why he shot a man on Tuesday.

That man, David Horton, was wanted for violating his probation.

The incident happened around 1:30 p.m. at the Walmart on South Memorial Parkway near Hobbs Road.

Investigators have reviewed surveillance video from Walmart, but will not comment on what that video captured.

The deputy, who police have yet to name, was dressed in plain clothes, driving his personal car and shopping at Walmart when it all began.

The deputy spotted Horton and attempted to arrest him, but Horton fled. There's no word on whether the deputy made it clear that he was, in fact, a deputy.

The deputy maintained it was an accidental discharge, while witnesses said he aimed and shot at Horton.

Morgan County Sheriff Ana Franklin said Huntsville Police Department will likely complete their investigation by the beginning of next week. At that point, it will be handed over to the district attorney.

Even if criminal charges aren't filed, Franklin said an internal investigation will take place.

Horton was shot in the buttock and taken to Huntsville Hospital to be treated. He is expected to be ok.
