Estate of Scottsboro Boy sues for wrongful imprisonment

SCOTTSBORO, AL (WAFF) -

A petition is now pending before the state for the wrongful imprisonment of one of the Scottsboro Boys.

The family of Clarence Norris, one of nine young African-American teens falsely accused of raping a white woman during times of segregation, wants the state to pay damages.

The family's attorney, George Hartline, believes the family has standing with the claim. He said Norris petitioned the state in 1982 after he was pardoned, but that petition was denied.

Since that time, Hartline said a law was passed which allows for those falsely convicted to make a claim.

The estate of Clarence Norris is now seeking damages from the state for being wrongfully imprisoned. Hartline said the state passed a law in 2001, which allows people who receive pardons for being wrongfully accused to be eligible for $50,000 or more for each year spent in jail before the pardon was issued.

Hartline said they are petitioning the state for 15 years, which equals a minimum of $750,000.

"You cannot give a person back time and things that they lose; the loss of time with loved ones, things in their own lives that they could have had. You can, in some way, with the financial aspect of it, say ‘Well, I'm sorry,'" said Norris' son, Clarence Norris Jr.

We have been in contact with the Governor's office and are awaiting a response. Hartline hopes the petition will be granted. If not, he anticipates there will be further legal action.
