Federal complaint filed against Kellogg's

(WMC-TV) – Kellogg's is now facing a federal complaint in the ongoing lockout affecting over 200 Mid-South employees.

Action News 5 received a release from the Bakery, Confectionery, Tobacco Workers and Grain Millers International Union (BCTGM) Local 252G, which represents the Kellogg's cereal plant's Memphis workers.

The release is the union's response to the decision by the National Labor Relations Board to file a complaint against the company, accusing it of violating federal labor laws.

This comes five months after the union lodged labor charges against the company and five months since contract negotiations between the two groups broke down. The breakdown put about 220 Mid-South employees out of work and on the picket line.

"It kind of validates everything that we've been out here doing," said worker Jack Miller regarding the lawsuit. "We're happy that things are looking well in our favor."

Federal labor officials say the company made unlawful demands and threatened the lockout during contract negotiations, which they say is a violation of labor laws.

"It says that we are right and they are wrong and the federal government is involved, and we see the issues at hand, and they understand the contractual language that's been broken, all the things that the company has failed to bargain in good faith," said union president Kevin Bradshaw. "It means that fight is almost over, but we gotta keep standing strong until the end ... One day longer."

Kellogg's maintains its actions have been legal . A hearing on the complaint is set for May 5 in Memphis.
