Atomic Safety and Licensing Board Rules in Favor of the MOX Project

The ASLB legal review of the objections lasted more than two years and included a formal hearing with extensive testimony, exhibits and an onsite visit by the ASLB to the MOX project.

"We are very pleased with the licensing board's decision which upholds the conclusion that the MOX facility meets the NRC's regulations for nuclear material control and accounting," said Kelly Trice, president and COO of MOX Services, which is constructing the MOX facility.  "Safety and security are top priorities in the design, construction and operation of the MOX facility."

The NRC's technical staff found the MOX project's proposed procedures for the physical protection and accountability of nuclear material used to produce MOX fuel acceptable in a safety evaluation report issued at the end of 2010.  In that report, the NRC concluded that the MOX facility would not pose an undue risk to worker safety and health.

 Shaw AREVA MOX Services, LLC has a contract with the U.S. Department of Energy's National Nuclear Security Administration (NNSA) to design, build and operate a facility to convert surplus nuclear weapon-grade plutonium into reactor fuel for use in commercial nuclear power plants.  This work supports NNSA's nuclear nonproliferation program to eliminate nuclear weapon-grade plutonium in the U.S.  Under a 2000 agreement, the United States and Russia will dispose of 68 metric tons of surplus plutonium, sufficient for approximately 17,000 nuclear weapons.  For more information, visit www.moxproject.com.
