Jefferson Co. couple awarded $7.5 million in malpractice case

JEFFERSON COUNTY, AL (WBRC) -

A couple in Jefferson County has been awarded one of the largest medical malpractice jury verdicts in the county's history.

The Borden family was awarded $7.5 million. According to court documents, Butch Borden began having severe back and leg pain after having lower back surgery in September 2010.

His wife rushed him to the Brookwood Medical Center ER where he was admitted. Staff determined he had a small blood clot near a bundle of nerves in his back. He also developed incontinence and the inability to move his legs.

According to testimony, these symptoms signified major neurological changes but court documents say no nurse ever called Borden's doctor about the problems. When the physician was made aware of the issues the next day, too much time had passed to successfully treat them.

Borden, who is 55-years-old, is permanently incontinent and impotent. Borden's attorneys hope this decision will have a major impact on the care hospitals give patients.

"This large of a verdict, it is huge and I think it sends the message that people here in Jefferson County are not going to tolerate this kind of negligence," Ashley Peinhardt said.
