Former Gov. McDonnell seeks dismissal of indictment

Former Gov. Bob McDonnell will ask a judge to dismiss his indictment on federal corruption charges, according to court papers filed late Tuesday.

McDonnell's lawyers will file a motion to dismiss the indictment on or before March 25, according to the latest document filed by the McDonnell defense team.

U.S. District Judge James Spencer will hear the motion for dismissal on May 19.

Lawyers for the McDonnells and the government will be back in court March 18 to discuss how much access the defense can have to evidence.

The trial is set for July 28 and is expected to last between five and six weeks.
