ALABAMA (WAFF) -

This week, the Alabama Department of Education planned to release a new list of failing schools.

The list comes with a lot of controversy. Some school leaders argued that one of the biggest problems with the list is that schools that have shown improvement in recent years are still considered failing.

Last year, 78 Alabama schools made the failing schools list. Nine were in the Huntsville City School District, including Butler High, Johnson High, Chapman Middle, Davis Hills Middle, Ed White Middle, Westlawn Middle, Martin Luther King, Jr. Elementary, Lakewood Elementary and James Dawson Elementary.

Brookhaven Middle School was the only school from the Decatur City School System on the list.

These schools are considered failing under the Accountability Act. That's determined by looking at standardized scores in reading and math.

The Accountability Act allows students in failing public schools to transfer to non-failing public schools or get a tax credit to pay part of the tuition at a private school.
