Defense files 7 motions to dismiss Colbert Co. capital murder indictment

COLBERT COUNTY, AL (WAFF) -

The attorney representing a Colbert County murder suspect has filed seven separate motions to dismiss the capital murder indictment.

Homajean "Lee" Grisham III is accused of killing Jessica Nicole Broadfoot. Investigators found Broadfoot's body on Fossick Lane in Cherokee in June 2013. 

Investigators say the found blood in Grisham's truck. According to the criminal complaint, Grisham admitted to stabbing Broadfoot while driving down Highway 72 in Colbert County. Investigators say Grisham also admitted to dumping Broadfoot's body on his father's property.

The motions to dismiss the indictment state prosecutors did not present all of the evidence to the grand jury. The motions also question the language of the indictment.

One motion questions the make-up of the grand jury, stating a "systematic exclusion of young adults ages 19 to 30". Another questions the system to select grand jurors.

The Colbet County Chief Assistant District Attorney filed a response stating the indictment is a "plain, concise statement of the charges". The response requests the judge deny the defense motion to dismiss. 

The judge has not ruled on the motions. A trial date has not been set.
