LIMESTONE COUNTY, AL (WAFF) -

A new appeal has been filed over a controversial sentence in a rape case.

The Limestone County District Attorney filed a second petition over Austin Clem's resentencing. Judge James Woodroof re-sentenced Clem last week, but still did not include jail time for his first-degree rape conviction.

District Attorney Brian Jones argues the sentence violates state law. He said Clem was not eligible for the community-based program.
