Contractor sues Jackson Co. school board for unpaid work

JACKSON COUNTY, AL (WAFF) -

A Jackson County contractor is suing the county's board of education. The lawsuit claims the system failed to pay him for work to repair a school gym damaged by the 2011 tornadoes.

The situation is complicated by the fact that the state came in and stopped work on the project because the building plans had not been submitted to the state. The contractor maintains they were properly employed but have not been paid.

In the suit filed by D.C. Pruett Contracting Company, the company is seeking nearly $100,000 for work done to repair the Pisgah gym. The suit maintains the board declared the situation to be an emergency and authorized the company to do approximately $300,000 in repairs to the gym in April 2012.

That was followed, according to the suit, with a purchase order given to the contractor by the superintendent of the board.

The suit claims work began and continued until late June, when the state ordered work be stopped. The contractor said in the suit that an invoice of just over $91,000 was submitted to the board for payment, but no payment has been made, nor have there been any objections to the amount owed.

Attempts to reach Superintendent Kenneth Harding have been unsuccessful.
