PHENIX CITY, AL (WTVM) -

Former Phenix City Superintendent Larry DiChiara has filed a lawsuit against the Phenix City Board of Education.

The suit was filed in Russell County today, Dec. 26, and requests a temporary restraining order against members of the Phenix City Board of Education.

A hearing is set for Monday, Dec. 30 10 a.m. EST in Russell County Judicial Court.  

Last month, DiChiara's contact was bought out by the school board even though he still had four years left on that contract.

DiChiara was a superintendent for nearly a decade. He was named Alabama Superintendent of the Year in 2012.
