ETOWAH COUNTY, AL (WAFF) -

A hearing will take place next month for a capital murder suspect seeking to have the charges dismissed.

Joyce Garrard is accused of making her nine-year-old granddaughter run as a punishment. The girl later collapsed and died. It happened last year at their home in Etowah County.

Attorneys for Garrard are asking the judge to dismiss capital murder charges. They said the girl had health problems and deny that Garrard is responsible for her death.

The girl's stepmother, Jessica Hardin, is also charged in the case.

The hearing is set for Jan. 10.
