Charges filed in both Cleveland Police Officer involved shootings

Charges were filed Friday against two men, both shot by Cleveland Police Officers in separate incidents earlier this week.

Xavier Hempstead, 29, is charged with failure to comply after police say he pointed a gun at them Tuesday night.  This happened in the 12200 block of Emery Street.

Officers were investigating a burglary and had information the suspect was in a black Infinity SUV. Officers found the vehicle with Hempstead inside and say they saw him lean back and point the muzzle of a gun at them. The officer then fired two rounds, striking Hempstead in the neck and chest/shoulder area.

A search warrant was executed and no gun was found in Hempstead's vehicle. He has since been released from the hospital and is at the Cuyahoga County Justice Center.

Felonious assault charges and failure to comply charges were filed against Demarkos Simmons, 22, for the second officer-involved shooting this week. 

On Monday, in the 3200 block of West 32nd Street, Simmons is accused of driving a stolen mini-van and refusing to stop for police officers. He allegedly backed into police vehicles and nearly ran over the officers. 

An officer fired four times, hitting Simmons in the stomach.  Simmons is also out of the hospital and is at the Cuyahoga County Justice Center.
