Attorney: Sheriff Byrd will resign today

By the end of the day, Mike Byrd will no longer be the sheriff of Jackson County.

Byrd's attorney, Joe Sam Owen, told WLOX News that Byrd plans to hand deliver his resignation to Board of Supervisors President Mike Mangum Wednesday night. Mangum is currently in Jackson, and likely won't be back in town until later this evening.

Tuesday, Byrd pleaded guilty to one count of witness tampering involving the abuse of a restrained and handcuffed prisoner, and a subsequent cover-up. Under state law, Byrd cannot serve as sheriff with a felony conviction.

Supervisors have been considering what to do when Byrd's resignation becomes official. But a search for his replacement cannot begin until that time.

"Once that happens then we will go about replacing the sheriff with an interim and then we're looking at a special election in November of 2014 to fill the unexpired term of the sheriff," Supervisor Mangum said Tuesday.

On November 3, 2015 there will be a regular election for sheriff.
