ATHENS, AL (WAFF) - An order filed late Tuesday in Limestone County Circuit Court states a convicted rapist sentenced to no jail time will be resentenced.
Limestone County Judge James Woodroof sentenced Austin Clem to community corrections earlier this month after his conviction on charges including first and second degree rape.
Limestone County District Attorney Brian Jones appealed the sentencing to the Alabama Criminal Court of Appeals.
An order filed by Judge Woodroof after 4 p.m. Thursday stated, "The Respondent herein stipulates to a re-sentencing in the above-styled matter."
The victim in the case, Courtney Andrews, who revealed her identity following the original sentencing, said she's trying not to be too hopeful that her attacker may yet go to prison.
"I have to prepare myself for the worst, so that I don't get my hopes up again," said Andrews.
She said that the only place Clem deserves to be is "in prison, where he can't hurt anyone else."
A new sentencing date has not been set.
