DA 'reviewing options' following rapist's suspended sentence

LIMESTONE COUNTY, AL (WAFF) -

The Limestone County District Attorney said he will try to fight the sentence given to convicted rapist Austin Clem. A jury convicted Clem on one count of first-degree rape and two counts of second-degree rape.

Judge James Woodroof sentenced Clem to four years of community corrections and six years of probation. Clem only goes to prison if he violates certain terms.

In a statement given to WAFF, District Attorney Brian Jones said:

As the District Attorney of Limestone County, Alabama, I am reviewing available options to set aside this sentence and to achieve a sentence that gives justice to our victim. At this time, I cannot comment publicly on the particulars of this case.

Clem's defense attorney, Dan Totten, said even he was surprised by the judge's sentence. He said he felt the jury should have never convicted Clem to begin with, but since they did, he fully expected his client would get time in prison.

"I want you to understand I was not nearly as surprised by the sentence as by the verdict of guilty. I thought the evidence was woefully insufficient to convict him," said Totten.

Judge Woodroof earlier refused to comment on his sentence. He was not in the courthouse Friday during another attempt to reach him.
